The drug company Pfizer’s patent on its erectile dysfunction drug Viagra has been revoked.
The move comes after US doctors who had been using Viagra as a treatment for erectile dysfunction in the UK, told a court in London, which was expected to take effect on Thursday.
The patent, which is due to expire on 31 December, has allowed Pfizer to market a generic version of Viagra. The company will be able to sell it for £4.5m per tablet, it said.
The ruling comes on the back of Pfizer’s first major patent expiry in the UK.
The company is planning to take over the patent for the erectile dysfunction drug by next year.
The company has yet to respond to questions from The Guardian, which said that Pfizer’s patent on Viagra, which was based on a patent application for the drug, had not yet expired.
The European Union has said that its medical drugs patent has been revoked, although the UK patent for erectile dysfunction, which is based on a patent for the drug, expired earlier this year.
In the US, Viagra was approved in 1998 and generic versions have been sold for as little as £5.50 a tablet.
“This is a blatant blatant infringement of the Viagra patent,” said Pfizer’s head of research at Pfizer’s pharmaceutical company, Pfizer Global PLC.
Pfizer is also pursuing a £3bn (£2.75bn) licensing deal for the drug, which expires on 20 April 2020.
The company will also be able to sell Viagra for about £1.50 a tablet, but this has not yet been confirmed.
